1. About WheelMarket
WheelMarket ("we", "us", "our") is an independent online marketplace that enables collectors to buy and sell Hot Wheels die-cast model cars. We are a platform provider only – we are not a seller of goods ourselves and do not take possession of any items listed on the platform.
Where these terms apply. WheelMarket is operated from the
Czech Republic and these terms are governed by Czech and EU law. The platform
is intended for users in Europe. Sellers are responsible for complying with
the laws of their own country and of the buyer's country — including consumer
protection, product safety, customs and tax obligations.
2. Eligibility
WheelMarket is open to users of all ages. However:
- Users under 18 years of age may only use WheelMarket with the consent and supervision of a parent or legal guardian. By registering, you confirm that you have this consent if applicable.
- You must provide accurate and complete registration information.
- You must not be prohibited from using the service under applicable law.
WheelMarket does not knowingly collect personal data from children under 13 without verifiable parental consent. If you believe a child under 13 has registered without consent, please contact us at wheelmarketcars@gmail.com.
Account rules
- Each person may hold only one account. Operating multiple accounts to circumvent limits, bans, or reputation is not permitted.
- You are responsible for keeping your login details secure and must not share them with third-party services or tools.
- You must keep your account information current and accurate at all times.
- You must not use automated tools to scrape or extract data from WheelMarket, except through an official API where one is provided.
- You must not attempt to divert WheelMarket traffic elsewhere — for example by including links to external shops in listings, messages, or physical marketing materials inside parcels. Links to your own social media or blog are acceptable.
3. Seller Responsibilities
Sellers are solely responsible for their listings. By listing an item you confirm that:
- You own the item and have the right to sell it
- The item is genuine (not counterfeit, not a reproduction marketed as original)
- All photos are your own original photos of the actual item
- Descriptions are accurate and not misleading
- You will ship the item within the processing time stated in your profile
Seller standards
To keep the marketplace reliable, sellers are expected to:
- Respond professionally to buyer messages, quote requests, and problem reports within a reasonable time (we recommend within 2 business days).
- Mark orders as shipped within your stated dispatch time, and actually dispatch them promptly afterwards.
- Ship to the delivery address provided in the order, unless otherwise agreed with the buyer.
- Only list items you physically have in your possession, and describe their condition accurately.
- Not cancel orders because of low value or high item count, and not routinely cancel or fail to fulfil orders.
- Not request additional payment after an order is placed, beyond what was agreed at checkout.
If a seller cannot supply an item as described, they should either source an acceptable replacement (with the buyer's agreement) or refund the buyer for the missing item. Persistent failure to meet these standards may result in a listing being removed or the seller's account being suspended.
Payment process
Payments are made directly between buyer and seller using the payment methods each seller offers (e.g. PayPal, card). Sellers must not attempt to circumvent WheelMarket's commission by moving agreed transactions off-platform after a buyer has engaged through WheelMarket.
Card payments via Stripe Connect
Sellers who want to accept card payments can connect a Stripe account to WheelMarket. This is optional — PayPal remains available and requires no such setup. What connecting a Stripe account means:
- Money goes straight to you. Card payments are created directly on your own Stripe account. WheelMarket never holds, receives or controls your funds, and takes no cut from the transaction itself. The 4% commission is billed separately, exactly as with PayPal.
- Stripe verifies your identity. To comply with financial regulations, Stripe requires your name, address, date of birth and bank details, and may ask for an identity document. This verification is carried out by Stripe, not by WheelMarket, and we cannot influence its outcome.
- WheelMarket can see your payment activity. As the operator of the Connect platform, we have visibility of transactions made through WheelMarket on your connected account — including payment amounts, balances and payout status. We use this only to operate the marketplace, resolve disputes and meet our legal reporting duties. We cannot access your bank account, and we will not move or withhold your money.
- You keep control. Your Stripe account remains yours. You can view it, manage payouts and disconnect it from WheelMarket at any time through your Stripe dashboard.
- Stripe's own terms apply. Fees, refunds, chargebacks and payout schedules are governed by your agreement with Stripe. Refunds and chargebacks are settled from your account, not WheelMarket's.
Prohibited items
The following are strictly prohibited on WheelMarket:
- Counterfeit or fake Hot Wheels items
- Items that infringe on third-party intellectual property rights
- Items you do not own or have no right to sell
- Any items illegal to sell in the seller's or buyer's jurisdiction
4. Seller Status and Tax Reporting (DAC7)
WheelMarket is an online marketplace subject to Council Directive (EU) 2021/514 (DAC7) and Czech Act No. 164/2013 Coll. Sellers acknowledge and agree that:
- Each seller must declare whether they sell as a private individual or as a professional trader. Sellers who exceed 30 completed sales or 50,000 CZK in total sales within a calendar year are required to register as professional traders.
- Sellers must provide the identification data required for DAC7 reporting when requested — including full name or business name, registered address, business ID (IČO), tax identification number (DIČ), and, for private individuals, date of birth.
- WheelMarket is legally obligated to report qualifying sellers and their income to the Czech Financial Administration (Finanční správa).
- If a seller fails to provide the required data within the stated period, WheelMarket will suspend the seller's account and pause their listings until the information is supplied, as required by law.
- Professional traders must offer buyers a 14-day right of withdrawal and the statutory 2-year warranty, and must display their business identification on their listings.
5. Buyer Responsibilities
Buyers agree that:
- They will complete payment promptly after placing an order
- They review listings carefully before purchasing
- They contact the seller directly for questions before buying
- The purchase contract is concluded directly with the individual seller, not with WheelMarket
- Consumer rights (14-day withdrawal, 2-year warranty) apply only when buying from a professional trader, not from a private individual
- WheelMarket is not responsible for the condition, authenticity, or delivery of items
6. Fees and Commissions
WheelMarket charges sellers a 4% commission on each completed sale, calculated on the item price only — shipping is excluded. There are no listing fees. Buyers pay sellers directly – WheelMarket does not process or hold payments. The commission is invoiced separately to sellers.
- Payment flow: Buyer pays seller directly (PayPal, card, or other agreed method)
- WheelMarket commission: 4% of the item price (shipping costs are not included in the calculation)
- No listing fees: Listing items is always free
- Buyer fees: None – buyers pay no additional fees to WheelMarket
- Billing: Commission is invoiced to the seller once the outstanding amount passes the minimum billing threshold
- Invoices for goods: WheelMarket does not issue invoices for the items themselves.
The sale is between the buyer and the seller, so any receipt or invoice is the
seller's responsibility. Professional traders are required by law
to provide one on request; VAT-registered sellers must issue a tax document.
Private sellers have no such obligation. Buyers should ask the seller directly.
7. Intellectual Property
WheelMarket respects intellectual property rights and expects users to do the same.
- Hot Wheels® is a registered trademark of Mattel, Inc. WheelMarket uses the name solely in a descriptive/nominative sense to identify the category of goods sold on the platform.
- Photos uploaded by sellers remain the property of the seller. By uploading,
you grant WheelMarket a non-exclusive, royalty-free licence to display them
on the platform and to promote the marketplace — for example
in social media posts, newsletters or ads showing what's for sale here.
We'll always link back to your listing. If you'd rather we didn't use your
photos for promotion, email us and we'll respect that.
- WheelMarket's own brand, logo, and design are our intellectual property.

8. Reviews and Feedback
Reviews left on an order should honestly reflect the experience with that order. Reviews must not:
- Contain personal data about another user
- Contain profanity or offensive language
- Be retaliatory (left purely in response to negative feedback received)
- Be used to ask a question rather than describe the transaction
- Concern matters outside the seller's control, such as postal delays or import duties, unless a genuine error was made
WheelMarket may remove reviews that breach these rules.
9. Messages
WheelMarket provides a messaging system to help buyers and sellers communicate. By using it you agree that:
- Messages must not be used to send unsolicited or spam content to other users.
- Messages are stored on our systems and may be reviewed by WheelMarket where necessary to prevent fraud, resolve disputes, or monitor compliance with these Terms.
10. Disputes Between Users
WheelMarket is a platform. Disputes between buyers and sellers are primarily the responsibility of the parties involved. We encourage users to resolve disputes directly. WheelMarket may, at its discretion, mediate disputes but is under no obligation to do so.
11. Limitation of Liability
To the maximum extent permitted by law, WheelMarket is not liable for:
- The quality, safety, legality or availability of items listed
- The ability of sellers to complete a sale or buyers to complete a purchase
- Any indirect, incidental, or consequential damages
12. Termination
We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or otherwise harm the community.
13. Governing Law
These Terms are governed by the laws of the Czech Republic and the European Union. Any disputes shall be subject to the jurisdiction of the courts of the Czech Republic.
14. Changes to Terms
We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of WheelMarket after changes constitutes acceptance.
